Child Abduction to Japan

Please tell us the truth if you are lying. Also, where did you get this information from?
the application for a return order under the Hague Convention is not retroactive. So cases such as his, which occurred in the past, and in which the children are already 13 years old, are not covered under any of the provisions of this treaty
 
Thank you for this link but my son doesn't want only to have access to his daughter in Japan. He wants his daughter back to live in France. I have not read everything and maybe I'm wrong.I hope with all my strength I'm wrong but we had so disillusioned that I became pessimistic.

You should have read the link I provided, so you can easily find the information you got is obviously wrong.

Sometimes we need to start with what we can get and then work towards what we want.
If your son truly wants a relationship with his daughter he will take the opportunity which is available and work to prove that he deserves more.
 
Serious advice: A return order, are you for real? After seven years and given the fact that she is now a teenager and apparently monolingual Japanese? Would you really force her to move halfway across the world against her will?

She's 13, which is old enough to have her own say. What her father wants is really not the most important thing here. Do you want a court to say you're right, or do you want her to still be talking to you in ten years time?

You have a line of communication, for the moment. Try using it to listen to her.
 
Off course 100% off course but he already do it. When you can see a child one or two times by year it's not enough. As long as my granddaugther will live in Japan relationship with her father will not deeply change. And I will also want to take care of my granddaughter here.

Anyway it was not a good idea to become a member of your forum. I regret because I hope finding support and not only criticism. But it's my fault and my way must be wrong. I regret.

  • When I said a return order, I mean by law, to her mother. Not to my granddaughter by force. If judge decided it can change her mind because actually nobody in Japan around her talk about and share this point of view.
  • It's in Japanese culture and it is no coincidence Japan decided to ratify the Hague Convention only recently. Japan was done because of the pressure from the international community.
  • I'm sorry about my English and I would like to express more deeply my mind but it's not my native language.
  • Please don't make mistake about my wish, the most important is the happiness of my granddaugther even in Japan and the peacefull of my son.

Sometimes criticism is the most honest support.

Your son can find a way to live in Japan and be near his daughter.

It all depends on what he believes is most important. My friend moved to Taiwan to be near his child when his ex-wife moved there away from him. He created a relationship and now he sees his child everyday.

Like I said, it all depends on priorities and if a person is willing to take the small opportunity and build it into what he wants.

I don't care if it is you or your son, I don't care because the only thing which is important is this little girl who is very sad and hurt. She is what matters in my opinion.
 
There is also the possibility that the mother taking the child and escaping with her back to Japan was in the child's best interest.

The good news is that you're at least talking to her. Keep that going as much as you can.

Make it clear that if she wants contact, if she wants to know more about your side of the family, if she wants some day to visit France (in a few short years her mother will have no say in that if you put up the funds), whatever it is she wants, she will be welcomed with open arms.

Even if right now she doesn't want to hear it, in a couple of years that might change.

Ah yes. The option so often not mentioned out of misguided sentiment, such as being nice or some sort of nationalism. I have seen several cases where where everyone was supporting the "gaijin". I always took these case by case, looking at facts and probabilities. I am still amazed how many supported Chris Savoie. I smelled a rat with that guy instantly. And I found several upon inspection.

I have no idea what is going on in this thread. Where is the other thread that led to this lambasting of the OP?

Yes. I realize I can hunt for the OP's messages and search and read through them all. I just wanted a summary or a specific offending post or two or a specific thread. His or her grammar is so atrocious its giving me a headache just reading this thread, so I suppose I should have clearly asked for the summary. But considering the hodge podge grammar, I think there may be a misunderstanding going on.

And you know, to get to the bottom of this, its not just what the OP wrote. Its also about how he or she is being interpreted. Not that I feel a burning desire to get to the bottom of this really.

Japan hasn't signed the Hague Agreement so Japanese women abduct children to Japan and fathers don't see the child. Has anyone non Japanese abducted a child from their country to Japan? Would they also ne unable to be returned home legally?
 
Ok. I remember 7 years ago people going on about this. I see its changed. Thanks. I guess Japanese women cant get away with abducting their child from the foreign parent anymore or a foreign child with one parent working in Japan. Well done Japan.

They signed it but that doesn't mean they will enforce it.
