Is a prenup accepted in Japan?

I am curious if a prenup is accepted in the court of law in Japan. I hear a lot about the prenup in USA and the richer of the couples protects his/her assets from the partner in an event of divorce. As a very ambitious individual, I know I am not comfortable with the prospect my hard earned assets and future earnings will be divvied up in half with the partner in an event of divorce.

Ｉ think in China the probability of divorce is lower. If you can find a man/woman who loves you and live with you well, you will not divorce. And then you will no need to divide your assets to him/her. Because they are yours.

If you have enough money and assets to be worried, you should be able to afford a lawyer to answer that question.

Personally I have the same feeling as Dave; you should make sure your future partner has the same sense of value as yours and both of you share the same view on marriage, otherwise bringing up the prenup issue could damage the relationship (very badly, I think) especially if she's Japanese.

Well, I don't want to go overboard on this. I was just curious how the prenuptial agreement is considered and upheld in the court of law in Japan. I heard a rumor there have been more wife-initiated-divorces once a husband landed a nice chunk of retirement package (Tai-shoku-kin).

Obviously, that's for older people, and yes, it seems to be happening more lately than before. I forget why, but there was a distinct legal reason for the frequency going up. Something to do with the legality of being able to take 50%.

All I hear about in Hong Kong is about those younger women from mainland who marry a richer older man just to divorce and get some money from him. Same thing are gossiped in several chinatowns in a couple of cities in the US.

Otherwise I don't know if it exists in other countries but in France we have the PACS which allows a "couple" to benefit from the benefits of a wedding without having one of two individuals share his assets once it is dissolved. The only problems are with assets bought together (ie: house, car and so on). This thing is also growing in popularity with over 60 000 contracts for an average of 250,000 weddings

That is true, but it is someone, not everyone, I think. And they are the just the small part of the colony.

Retired Husband Syndrome

I think I heard something to the effect of what you are saying, but I think that additionally, the stigma associated with divorce has been gradually falling away in recent years.

It's the same anywhere: do your best to maintain a happy marriage, marry a woman who's not a gold digger in the first place, and you significantly reduce the likelihood of divorce.
I think there are very few ordinary women who would leave a stable marriage simply to take their husband's money and run.
