At first I thought that they would intentionally offer worn underwear like in Japan... but such a thing would be absolutely impossible in the prude US. After reading the article, everything cleared up - they are just reselling underwear that was returned by costumers, which is something completely different. I think it would be a good idea to prohibit the the sale of underwear already worn by others for obvious hygienic reasons.
Over here in Germany, it is forbidden since a long long time already (has ever been that that way afaik). Underwear (and bathing suits as well) are explicitly exempted from the return policy, and you're not allowed to try them on either. Often, you'll also find signs that it's not allowed for hygienic reasons.

But the shops work in the way, that the girls selling their used underwear take their picture, a picture of them in a school uniform or whatever, and the picture is then put on the outside package for the used panties, so that the customer can choose a panty and it's former owner that he likes the best... Or so I've heard.
But still - you're probably right, the shopowner wears the panties for a day or two and then puts a random girls picture on the panty. Easy as that, and makes loads of money!
