Earlier this week, a 14-year-old girl and her mother sued Myspace for $30 million, alleging the site failed to protect her from being sexually assaulted by a 19-year-old guy. Now, in a bizarre twist, the man's attorney says that if Myspace is liable for not keeping the girl out of harm's way, his client might also have a claim for damages, since the girl misrepresented her age, adding that the accused rapist, who's admitted having sex with the girl, is "just as much a victim -- if not more." This case, should it be filed, would be even more spurious than the girl's claim -- the fact that the two met on MySpace has absolutely nothing to do with the alleged sexual assault, and the guy really doesn't have much of a case if he's basing his on the girl lying about her age, since he apparently falsely represented himself as a high school football player. It's impossible to describe these suits as anything other than ridiculous, but with all the hype of the dangers of Myspace and other social-networking sites -- and the money flowing around -- inevitably, there will be more.

Thought this was an interesting story.

I somehow missed this since I've been kind of busy all over the place but here, these past two weeks or so.

I would not be surprized if we were to hear more and more of this kind of stuff. Thanks for the share CC1 san !! MM

Wow that's pretty rediculous.
They should drop both suits and slap the mom for not paying more attention to her child.

Seriously, and you know what sometimes its not always the pedo looking for the kid. The first time I had ever heard of MySpace was last Summer by my little cousin who is only 12. She had a profile saying she was 16, and her picture was of her in a Bikini by the pool.

I mean have you SEEN some of the profiles of those young girls?
Its the parents fault not MySpace's.

Oh snap she's only 12! Yikes!

j/k :p
Besides thats like half the women on myspace aka meatspace.

Lying about your age is a common mistake of young people. Sexual assault isn't. Is the offender claiming it was consentual? Otherwise, he's still in deep doo doo regardless of the age.

If it was rape then yes by all means Justice needs to be served but if it was consentual and Age was lied about. Then This sound more like a parenting issue.

Do you think that even though the girl was 14?

Even if it was consentual it still would be considered rape according to the law.

It's not solely a parenting issue, but it certainly bears some of the responsibility. Where did they meet? How did a 14 year old girl find herself alone with a 19 year old boy? Why didn't her age come up sometime before the act was committed? Why didn't his? Do 16 year old boys look like 19 year olds?

How can they be suing myspace? Certainly myspace was the venue through which contact was made, but there are many ways for this to happen. Do people sue AOL, yahoo, google, and any other messaging/chat providers? Do they sue Al Gore because he "invented the internet?"

I hate to be a cynic, but in today's world, another question warrants investigation: was this the intended result of the girl and her mother in an effort to get money from myspace?

That's the whole point of it now isn't it? I have noticed in my time living away from the US that the number of ludicrous lawsuits has increased seemingly a million fold. People as always looking to find somebody to blame and make a buck off of.

Heck what about the "alleged"(snicker snicker) rape case involving the Duke University Lacrosse team. That's another case of people looking to get money off of "someone" isn't it?

I dunno, subjecting a 14 year old girl to sex with an adult and a stipper giving "happy endings" to lacrosse guys don't really sync up for me in terms of money grabs. Strippers are already "******" in the sense that they'll go to lengths for money that most people won't. This myspace thing sounds more like a mom trying to cover up her humiliation at being labeled a terrible parent by blaming it on someone else.

I seriously doubt the original intention of the girl was to get money from myspace by being sexually assaulted by someone she met on the site, which is what I meant in my original post.
