Reading this article on asahi shinbun earlier , made me feel frustrated today.

Specifically this part

ヤマト運輸は22日、1997年からサービスを提供してきた「クロネコメール便」を今年3月末で廃止すると発表した。郵便法で日本郵便だけに扱いが許されている「信書」にあたる文書を客がメール便で送ってしまい、郵便法違反容疑に問われる危険を防げないためだという。

信書は、法律で「特定の受取人に差出人の意思または事実を伝える文書」と定められている。だが、ヤマトによると、この定義があいまいで周知も不十分なため、顧客がクロネコメール便で信書を送り、書類送検されたり事情聴取されたりした事例が2009年7月以降に8件あった。

Now, The first question is, in both paragraphs, who is getting sued for 郵便法違反? In my comprehension its The customer.


And The second one, (someone who lives in japan will surely know better) , is it prohibited to send personal letters via any service other than 日本郵便 ? And will The sender instead of The company get 事情聴取される?
 
I suppose the last sentence of the article confirms your suspicion:

Not sued....prosecuted. Entirely different matter. (Criminal law, not civil law).
 
In addition to 書類送検 you will also sometimes see 身柄送検, depending on the type of offense involved. The former refers to the police sending papers regarding a matter to the public prosecutor's office for further action (if any, at the discretion of the prosecutor). The latter refers to transferring custody of an arrested suspect from the police to the public prosecutor's office.

What got me frustrated in the first place is the fact that I was expecting the company to get punished for the violation, but I couldnt find a way to make the text look like it was being prosecuted.

It sounds like BS to me. I suspect that it is actually a matter of the service not being profitable and Yamato looking for an excuse to drop it without making themselves look bad.
