I am trying to find something out here, and thought some of the long term residents here might know. I am getting divorced (my husband is japanese), and am expecting to get custody of my 2 children, and they will be living with me here, in Japan, for the time being. As I am not listed on the Juminhyo,
after the divorce, this means only they will be listed on it.
So I am wondering if this will cause any problems. I guess I should just go
down and face the City office folks and ask them.☝
By the way, as a foreigner, you have NO legal rights. If you want any, I suggest you take your kids out to scotland without his knowledge. Then, he will have to come to the UK to have laws that will give you more protection. In Japan, the Jap is always right. He could even legally marry another Japanese in front of your eyes, and they will not blink since you are a foreigner. Japan is not quick to also recongize foreign marriages too, and when they do, they will do something only when the Japanese is marrying another Japanese. Japan will fight for a woman who is even overseas Japanese who is Nissei, or even a Brazilian Nikkeijin before giving any consideration with you. I therefore decided that if I marry my Japanese boyfriend, that we raise our children in either the UK or Canada. In Canada, he could NEVER pull off some BS that he would be able to in Japan.
By the way, did you know that if you had married in the UK, and he did not choose to register you on his Koseki, he can LEGALLY marry a Japanese national without it being considered adultery? He can turn around and say he doesnt know you, and if he was smart enough to have all the kids even be born in the UK without registering your children to have a Japanese nationality, he could really choose to have 2 wives. And the Japanese to not have UK, and never sponsor his Japanese wife to the UK, and he could play a dangerous game.
I even have recently considered not marrying my boyfriend due to all this. I chose to stay cohabitated, (which they recognize in Canada as common law unions, but this would DEFINATELY NOT transfer to JAPAN.)
So, if your husband is a dual national, what you need to do is tell him that you will show his UK passport to the Homukyou and report his dual national status. He will then be forced to choose a nationality, and you can get him good if he chooses to screw with you. If he chooses to remain British with you, and follow you to your custody battles, at least you will be dealing on fairer ground as the British justice system is not a racist one.
