why are they still war criminals?

Is ex post facto permitted in country with a constitutional government?

japan never approves that as a country with a constitutional government.

I read the preists at Yasakuni interned the war criminal souls without telling the emperor, he was apparently "furious".

I think to solve that issue, Japan might have to considor changing Shintoism so that souls can be removed from a shrine, like a grave can be dug up and burried elsewhere.

some extra information to the topic, who are the war criminals:

On October 17, 1978, 14 Class A war criminals (according to the judgment of the International Military Tribunal for the Far East), including Hideki Tojo, were quietly enshrined as "Martyrs of Shōwa" (昭和殉難者 Shōwa junnansha), ostensibly on the technicality that they were on the registry. They are listed below, according to their sentences:

Death by hanging:
Hideki Tojo, Itagaki Seishiro, Heitaro Kimura, Kenji Doihara, Iwane Matsui, Akira Muto, Koki Hirota
Lifetime imprisonment:
Yoshijiro Umezu, Kuniaki Koiso, Kiichiro Hiranuma, Toshio Shiratori
20-year imprisonment:
Shigenori Togo
Died before a judicial decision was reached (due to illness or disease):
Osami Nagano, Yosuke Matsuoka

It restores honor substantially though Japanese Government is not officially declaring the war crime's restoration of honor.....
The war crime doesn't correspond to the criminal in a domestic method by the one judged by International Law.
that is,the necessity of restoration of honor doesn't exist.
Anyway there are alot of discussions about that...
It is only a result of the decision that Japanese Government accepted.
That is, the recognition of the fact and the reason of decision in court was
not accepted.
As for the criminal, a viewpoint turns into an ex-convict at point in time when the execution of the punishment that law determines was completed in Law-abiding country.
on the other hand, "Class-A war criminal" is recognized as a war criminal in the international society now etc....

By the way
there is a story.....

karuma of Walton Harris Walker

http://www.arlingtoncemetery.net/whwalker.htm
he was a person in charge of execution by hanging.
He treated war criminal's remains like dog's shits.
He died of the accident on the Emperor's birthday.
that is, same day of excution.

One Japanese lawyer of Tokyo war crimes tribunal
got a part of their remains at the risk of his life.
and They were buried in Atami shizuoka.
1959, Statues of goddess of mercy were built with a calligraphy
of PM Yoshida.
1971...students of left wing extremists,They blasted it.
However ppl of Atami and many volunteers restored it hard......
