How to say "This person is short"

Hi yall. Just a simple question. If I want to say "this person is short" is it:

このひとはせがひくいです or このひとがせがひくいです? Basically, is it が or は, and why?

The former one is a description about that person, and the latter is an answer to a question of looking for a short person, for instance. Thus, the former is more commonly used, as you can see from the usage.
